In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (” Law“), Cibeles Abogados, S.C. (” Cibeles“), residing at José María Velasco 110, San José Insurgentes, Benito Juárez, 03900, Mexico City, Mexico; as responsible for the use and protection of personal data of both visitors to our website www.cibelesabogados.com (“Website“) as well as any other persons who provide us with personal information through the same or any other institutional means of Cibeles in order to hire legal services Cibeles (“User“); the following is reported:

What personal data of the User do we collect?

Cibeles may collect the following personal data and sensitive personal data:

  1. Identification data: name and surnames, nationality, date of birth, place of birth, place of residence, address, education level, language, profession and/or occupation, financial and patrimonial data, mental and physical health status, socioeconomic status, genetic information, sexual preference, handwritten signature, official identification data, names of family members and friends, correspondence, etc.
  2. Contact data. mobile phone number and email address.

For what purposes will the User's personal data be processed?

In accordance with the provisions of the Law, the User is informed that all data obtained as a result of an information request through the Website, as well as data derived from the execution of the contractual relationship that Cibeles may establish with each of the Users, will be processed by Cibeles as the data controller.

The User’s personal data will be processed for lawful purposes and to fulfill the obligations stipulated in the contract for the provision of legal services that Cibeles enters into with each of the Users.

Whenever the User has explicitly or implicitly accepted it, the data collected by Cibeles as a result of the provision of its services – other than the personal and sensitive personal data of the User – will be processed for marketing, statistical, advertising, promotional, informational, or prospecting purposes, quality surveys, service improvement audits, fraud prevention actions, and the development of prediction models.

Data processing period for the User's personal data

The User’s personal data will be processed for the time necessary to fulfill the purposes for which Cibeles is contracted and/or as long as a contractual relationship between the User and Cibeles is in force.

User's Consent and Revocation thereof

The User expressly consents that by accessing the Website and providing Cibeles with their personal data through any institutional means owned by Cibeles, or by contracting goods and services, Cibeles may use the collected personal data for the purposes described above.

It will be understood that the User tacitly consents to the processing of their personal data when, after being provided with the privacy notice through the Website or in person, they do not express their opposition.

The consent granted by the User may be revoked at any time without retroactive effects.

ARCO Rights

The User has the right to know what personal data Cibeles holds, how it uses it, and the conditions of its use (Access). Likewise, it is their right to request the correction of their personal information if it is outdated, inaccurate, or incomplete (Rectification); to have it removed from our records or databases when they consider that it is not being used properly (Cancellation); as well as to oppose the use of their personal data for specific purposes (Opposition). These rights are known as ARCO rights.

What are the means that Cibeles offers to the User to exercise ARCO rights (access, rectification, cancellation, or opposition), or to limit the use or disclosure of personal data collected in accordance with the Law and, where appropriate, data transfers that are made?

To exercise any of the rights of access, rectification, cancellation and opposition (“ARCO Rights”), the User and/or owner of the data must communicate it in writing to Cibeles, by sending an email to cibeles@cibelesabogados.com, indicating what information or data you want to access, rectify, cancel or oppose the use; indicating as reference “ARCO Rights”. A copy of an official identification document should be attached.

Procedure and means by which Cibeles will communicate changes to the privacy notice to data subjects, in accordance with the provisions of this Law.

This privacy notice may undergo modifications, changes, or updates due to new legal requirements; our own needs for the products or services that Cibeles offers; our privacy practices; changes in our business model, or other reasons.

Cibeles commits to keeping the User informed about changes to this privacy notice, through the Website, by simply publishing the new applicable provisions, and the User is responsible for reviewing the legal notice periodically. The use of the site will constitute the User’s acceptance of the provisions applicable to the site, whether or not they are included in this privacy notice.

Jurisdiction

For the interpretation, execution, and compliance of this privacy notice, the parties agree to submit to the jurisdiction of the Federal and/or local Courts with headquarters in Mexico City, expressly waiving any other jurisdiction that might correspond to them due to their present or future addresses.

Acceptance of this Privacy Notice

The User declares to have read and fully accepted these terms and conditions in effect at the time of accessing the Website and/or using the Services. Likewise, the User agrees that it is their obligation to be aware of the updates to this Privacy Notice in accordance with the Law, which will be available to the User through the Website at all times.
